RENTAL TERMS

The terms and conditions for hiring a vehicle with ASR Rent A Car LLC can be found below. ASR Rent A Car LLC advises all customers to read all terms and conditions before the signing of the contract. By signing the contract, the Hirer agrees to all stipulated terms and conditions; such terms and conditions have to be adhered to by the Hirer or can be subject to Fines and Penalties in accordance to the terms and conditions and the Rules of the UAE.

Hirer follow and execute all terms and conditions mentioned in this contract between ASR Rent A Car LLC (owner) and Hirer.

A. Terms and Conditions:

The following documents are required upon handing over of the car:

Passport in English language (a notarized translation is required for Chinese customers).
Emirates ID for UAE residents / Nationals.
Driving license that should be at least 1 year from date of issue.
Valid Credit card.

B. Obligations of the Hirers:

The Hirer agrees to take good care and use the car properly
The Hirer agrees that he shall pay one (1) month rental as deposit at the time of hiring the car, (any changes in deposit amount shall be subject to mutual agreement between Owner and Hirer).
Rental charges should be paid in advance unless there is previous Agreement between the Parties.
The Hirer shall be responsible for correctness of all data and information relating thereto contained in the contract without any liability to the Owner.
In case of renting through any third-party e-commerce websites; all dues must be paid in full and prior to the signing of the agreement.
The Hirer shall pay the full rental fee, pay the value of the traffic violations if any, and pay the value of the SALIK/Toll gate and any damages to the car during the rental period.
The Hirer shall pay parking charges as applicable.
The Hirer must pay AED 4/- for each SALIK,DARB/TOLL gate he uses.
The Hirer shall drive, use and maintain the car in accordance with the rules and customs followed in this regard, and in accordance with the terms of this contract and in accordance with the RTA rules and Laws of the United Arab Emirates.
The Hirer shall bear all damages and liabilities arising from the breach of this Agreement and UAE driving rules and the Owner shall not be under any liability or responsibility for any violations by the Hirer.
If the Hirer loses or damages the key, the Hirer shall pay a penalty of up to 10,000 AED subject to the make and model of the vehicle. The Hirer is liable to pay for the rental days lost as a result of damage/loss of the key.
The Hirer undertakes to keep sufficient oil and water in the car during use.
The Hirer must do oil change and do other services which are required on an immediate basis and the Hirer may come to the Owner's office or the Owner's staff can pick-up the car and return it once the service is done. Any repair/service done by the Hirer without the company's approval shall not be honored and refunded and the Hirer shall be responsible to pay charges for any changes or damages done during the repair service.
The Hirer understands that the car is for use within the United Arab Emirates only and cannot be taken to the borders or to any of the neighboring countries. I the car is taken out of the UAE borders, then the Hirer shall return it immediately and bear all return expenses in addition to a penalty of AED 50,000/-. If such a situation arises the Rental Agreement shall be canceled by the Owner.
If the car is taken to dangerous areas like mountains, off-roads, desert areas, prohibited areas and if the Hirer or any third party participates in any racing/drifting events with the Owner's car, the Hirer shall be subject to a penalty of AED 10,000.
In case of renting the car for business purposes, the rental agreement amount must be paid in full prior to the signing of the Agreement.
The insurance company does not cover any damages or accidents resulting from the use of the car outside the asphalt road. All damages and applicable penalty from point no 14 shall be charged to the Hirer.
What you take, what you return policy applies on fuel. If fuel level was not the same at the time of car return, then charges may apply. No refund will be given for fuel costs in case the car was taken with low fuel and was relumed with full fuel.
If an accident happens while the Hirer is under the influence of alcohol or drugs, the Hirer shall be responsible for all the damages occurred, including all legal penalties by the authorities as well as the rental charges during the period of repairing.
The Hirer shall be responsible to pay the full amount of the repairs as well as the daily rental of the car if it is stopped because of damage or loss caused by his carelessness or negligence.
In case of any accident minor/major, an accident report from police is mandatory. All accidents minor or major shall be reported to Police.
In case of any accident wherein the Hirer is at fault, the Hirer shall be liable to pay all the accident related penalties and expenses by the UAE authorities.
In case the accident happened not due to the fault of the Hirer, then no insurance access fee will apply as long as a valid Accident Police Report is produced by the Hirer. If the Hirer fails to produce the police report then the Hirer shall pay for the Accident repair charges in full as well as the rental charges until the period of repairing.
The Hirer shall make sure that the car is parked in a safe place and not prone to any danger. If a vehicle is damaged because of these circumstances, the Hirer will be responsible to pay the full applicable amount for the repairs as insurance cover does not apply in such situations.
The Hirer must ensure that the Tyres and Rims of the car are not damaged. In case of damage to either one, the Hirer bears full responsibility for the replace-mentrepair of these parts.
ASR Rent A Car LLC is not liable for any property, loss of life or public property damage due to the negligence of the driver.
Any damage (tear, removal, out, etc.) to the Wrap/PPF would result in the Hirer paying the complete cost of its replacement and rental days lost.
Any damage to tires will result in Hirer paying for replacement of tires in pairs.
Only the Hirer of the car, as per the rental agreement is permitted to drive the rental vehicle. If any other individual is found driving the vehicle, without a rental agreement under his or her name; can result in a penalty of up to 50,000 AED. Furthermore in case of any accident or total loss, the individual driving the vehicle at the time will be liable to pay the full cost of the car along with facing legal action if necessary.
Hirer shall be responsible for any complaints from official authorities regarding the car that occurs within the Hiring period.
Hirer shall be solely responsible, the car is used for transportation of forbidden or illegal items as per UAE which includes carrying alcohol and drugs, during driving or driving after consumption of alcohol or drugs. If caught, the Hirer shall bear all applicable penalties and fines until settlement is done between the Hirer and the Owner. The Hirer shall indemnity the Owner from any risk that occurs due to such acts of the Hirer.
The Hirer shall not use the car for towing of other cars, if any damage occurs to the car, the Hirer shall bear full responsibility.
The Hirer pledges that the person driving the car is licensed to drive in the UAE and he shall be responsible for the consequences if the laws are violated.
The Hirer must not exceed 160 km/h on the roads of UAE. The Hirer may be subject to penalties from the rental company.
The Hirer can drive a maximum of 200 kms per day, 1500 kms weekly and 6000 kms monthly. Excess charges of AED 2 - AED 15 per kilometer shall apply upon exceeding this limit depending on the car type.
The Hirer shall not move or remove the Salik tag and it found so, a penalty of AED 500 shall be payable by the Hirer to the Owner.
In case of early cancellation of Agreement by the Hirer, the Hirer will be charged according to the rates of that period of rental. The rates applied can be the daily or weekly rate, depending on the return period.
In case of total loss of the car, the Hirer shall pay the cost of the insurance access fee and the difference between the insured value and the actual pay-out value by the insurance company, in addition to the daily rental rate for the days spent at courtyard/impound lot workshop if any.
The Extension of a hire must be notified at least 24 hours in advance. Confirmation of such extension is subject to approval of the Owner and upon the payment of advance rental amount and additional deposit if required.
One-day hire means 24 hours and extra hours will be calculated as full day.
The Hirer shall inform the Owner and the police immediately after any traffic accident or car damage and obtain an official report and submit it to the Owner. it is not permissible for the Hirer to repair the car by themselves without consulting the Owner. If it is proved that the Hirer has repaired the car without notifying the Owner, the Hirer shall pay a penalty of up to AED 20,000.
The Hirer shall bear the value of repairing the car or the value of the car in case of total loss if the insurance company refuses to bear it due to violation of the insurance conditions.
In case of car retention/impound by any official authorities within and outside the UAE, the Hirer is obliged to release the car and pay all the related lines, less, expenses and damages that may occur as well as the daily rental value until returned to the owner.
The Hirer is obliged to pay all applicable charges, VAT and all obligations incurred upon returning the car or immediately upon the Owners claim without delay.
All the conditions that apply to the Hirer shall apply to the driver of the Vehicle.
The Hirer must not tamper with the GPS device and if found tampering with the GPS device, a penalty of AED 10,000 will be applied.
In case of any mechanical damages that occur to the car, the Hirer should stop the car and inform the Owner immediately.
All ASR Rent A Car LLC vehicles are non-smoking, if the Hirer smokes in the vehicle; a 1000 AED cleaning charge will be applied.
The Hirer should not sub-hire the car or use it for commercial purposes (private passenger transport).
The Hirer must return the car in clean condition, otherwise AED 50.00 will be charged towards cleaning.
In case of an accident in which the Hirer is at fault receives the red paper from Dubai Police. The Hirer is liable to pay the insurance excess of AED 2000-AED 5000 depending upon the vehicle and 20% of the accident repair valuation as compensation to ASR Rent A Car LLC as per insurance policy and rental days lost. In case of no police report the Hirer will be liable to pay the full cost of damage.
The Hirer must return the car to the office of the Owner. In case of non-compliance, the Hirer shall bear all transportation charges and any associated traffic fines from the parked location.
The Hirer should ensure that the car and all accessories shall be returned in the same condition as it was at the time of initial hire.

C. Obligations of the Owner:

1. The Owner shall deliver the car to the Hirer in good condition.
2. The Owner has the right to exercise legal action against the Hirer if the agreement conditions are violated.
3.The Owner shall have all rights to charge the Hirer for all traffic violations, fines and fees.
4. The Owner may remotely control the car and prevent its operation in case of any payment obligations (non-payment/dispute) or violations of the terms of this Agreement. This Agreement remains valid until the car is delivered to ASR Rent A Car LLC.
5. The Owner has the right to terminate the Agreement and retrieve the car from the Hirer at any time at its own discretion without any particular reason.
6. A Security Deposit amount will be blocked from the credit card of the Hirer or as cash which will be returned after 30 days upon the end of the hire period and if there are no fines/penalties or any other extra charges that amount will be deducted from the deposit or blocked amount.
D. Jurisdiction and Applicable Law:

In case of any dispute between the Parties, this Agreement shall be governed by the laws of the United Arab Emirates. The Courts of Dubai, United Arab Emirates shall be competent to hear any dispute arising out of or from this Agreement.
